Terms of Service

These terms govern your use of WhichBookWhen, a book-club scheduling service operated by Murray Software, LLC ("we," "us"). By using the service, you agree to these terms. If you don't agree, please don't use the service.
1. Who can use WhichBookWhen
You must be at least 13 years old to use the service, and old enough to form a binding agreement in your jurisdiction. If you use it on behalf of an organization, you represent that you're authorized to accept these terms for it.
2. What the service does
WhichBookWhen lets book-club organizers create date polls and send invitations and reminders to their members by email — including, optionally, from the organizer's own connected Gmail account. Members respond through a private link without creating an account.
3. Your account
Organizers sign in with Google. You're responsible for activity that happens under your account and for keeping your Google sign-in secure. Tell us promptly if you believe your account has been used without your permission.
4. Acceptable use
When you use WhichBookWhen, you agree that you will not:
- add members' email addresses without their permission to receive book-club emails from you;
- use the service to send unsolicited bulk email, spam, or any message unrelated to organizing your book club;
- send unlawful, deceptive, harassing, or infringing content;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the service; or
- use the service in violation of any applicable law or the policies of the email providers involved.
You are the sender. You are solely responsible for the people you add, the content you send, and compliance with anti-spam laws such as the U.S. CAN-SPAM Act. We may suspend or terminate accounts that we reasonably believe are sending spam or otherwise violating these terms.
5. Sending email through your Gmail
If you connect your Gmail account, you authorize WhichBookWhen to send the poll and
reminder emails you initiate, on your behalf, using Google's gmail.send
permission. We do not read or modify your mail. You remain responsible for the
content and recipients of every message sent from your account. You can disconnect
at any time from within the app or at
myaccount.google.com/permissions.
6. Member information
When you add members, you represent that you have the right to provide their names and email addresses and to contact them about your book club. Our handling of personal information is described in our Privacy Policy.
7. Intellectual property
You keep all rights to the content you create (poll details, member lists, notes). We keep all rights to the WhichBookWhen service, software, name, and branding. We don't claim ownership of your content, and you grant us only the limited rights needed to operate the service for you.
8. Availability and changes
WhichBookWhen is provided free of charge and on an "as is" and "as available" basis. We may change, suspend, or discontinue any part of the service at any time, and we don't guarantee it will be uninterrupted or error-free.
9. Disclaimers and limitation of liability
To the fullest extent permitted by law, we disclaim all warranties, express or implied. We are not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the service. Because the service is provided free of charge, our total liability for any claim relating to the service is limited to one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless Murray Software, LLC from claims, damages, and expenses arising out of your use of the service, your content, the emails you send, or your violation of these terms — including claims related to spam or to the member data you provide.
11. Termination
You may stop using the service at any time and delete your clubs, polls, or account. We may suspend or terminate your access if you violate these terms or use the service in a way that could harm others or the service.
12. Changes to these terms
We may update these terms from time to time. When we do, we'll revise the effective date above. Your continued use of the service after changes take effect means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Maine, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Maine.
